📄 Terms and Conditions (AGB) for Using the Booking Platform www.best-preis.net
- Scope
These Terms and Conditions apply to all contracts concluded via the online platform www.best-preis.net between the guest (hereinafter “Customer”) and the operator (www.Best-Preis.net – Guido Gall, Buutendörp 19, 19322 Breese / OT Kuhblank) for the booking of holiday accommodations. - Subject of the Contract
The platform offers holiday apartments from private and commercial providers for temporary use. By booking, the customer receives a time-limited right of use for the respective accommodation. - Conclusion of Contract
The presentation of accommodations on www.best-preis.net does not constitute a legally binding offer but an invitation to book. By submitting the booking via the “Book now” button, the customer makes a binding offer. The contract is concluded once the booking is automatically confirmed by the system (Smoobu) or manually by the landlord. - Prices and Payment Terms
All prices include statutory VAT and ancillary costs (e.g. electricity, water, internet) unless otherwise stated. Payment is made via the offered payment methods, primarily Stripe (credit card, Apple Pay, etc.). The total amount is due immediately upon conclusion of the contract. - Cancellation Policy
Free cancellation is possible up to 24 hours before check-in. In case of later cancellation or no-show, the full overnight price is due. Cancellation must be made in writing (e.g. email) and is only valid after written confirmation. - Customer Obligations
The accommodation must be treated with care. Damages must be reported immediately to the provider. The specified maximum occupancy must not be exceeded. Pets are only allowed with explicit consent of the landlord. - Liability
The platform operator only provides the technical infrastructure. The respective provider is solely responsible for the correct execution of the rental agreement. Liability of the platform operator for injury to life, body or health as well as intent or gross negligence remains unaffected. - Right of Withdrawal
Consumers generally have a right of withdrawal, which, however, does not apply according to § 312g para. 2 no. 9 BGB for short-term accommodation. We voluntarily grant free cancellation up to 24 hours before arrival (see point 5). - Online Dispute Resolution
The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr
We do not participate in a dispute resolution procedure before a consumer arbitration board. - Applicable Law and Jurisdiction
German law applies. Jurisdiction is – to the extent legally permissible – the registered office of the platform operator. - Severability Clause
Should individual provisions of these terms and conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
